Ko Wen-je's request to copy data from three phones granted; High Court restricts its use

The High Court has agreed to let Ko Wen-je's lawyers copy data from the seized mobile phones — good news for Ko's defence, though the court has also imposed limits on how the material may be used.

  • The High Court granted the defence counsel's request to copy data from three mobile phones stored on the seized hard drive, and additionally added the contents of an HTC phone.
  • The defence argued that prosecutors extracted only conversations with co-defendants, omitting records of Ko's exchanges with the Taipei City Government, the Taiwan People's Party and his campaign team, which may contain evidence favourable to Ko.
  • The court ruled that the data must not be distributed, publicly broadcast, re-copied or used outside the litigation; prosecutors raised no objection to the copying.
  • After the inquiry hearing, defence counsel received roughly 250GB of electronic files. The ruling remains subject to interlocutory appeal.
  • Ko Wen-je was sentenced to 17 years at first instance for taking bribes, misappropriation of public-interest funds and breach of trust. On appeal he argues that all of the political donations were properly documented, and asks to be acquitted.

Outlook: The High Court will hear the political donations portion first, and has summoned Ko Wen-je to appear on 16 November.
