The Kaohsiung District Court's ruling in the recall petition forgery case is bad news for those who pushed the recall campaign, and it has also drawn public attention to the risk of personal data being misused.

• Hsu Shang-hsien, head of the main station for the "Kaohsiung Double Recall" drive targeting DPP legislators Huang Jie and Hsu Chih-chieh, was sentenced to 2 years with 5 years' probation over falsified signatures, plus a separate 5-month sentence for forging the list of proposers.
• The court found that he had copied personal data from sources such as old Kuomintang membership rosters into petition forms, stamped them with the lead petitioner's seal, and mixed them in with genuine lists to pad the numbers.
• The court determined that 111 entries were forged in the Huang Jie recall case and 262 in the Hsu Chih-chieh recall case, and that falsified lists were submitted again after the Central Election Commission rejected the filings.
• Lead petitioner Chu Lei was acquitted because prosecutors could not prove he knew the lists were falsified. The case may be appealed.

• Both Hsu Chih-chieh and Huang Jie stressed that recall is a right of the people, but that it cannot be built on illegal acts.

Outlook: The case can still be appealed, and whether personal data is being misused will become a key point of scrutiny in future recall petition drives.
