Taiwan Railway employee wins court case over transfer after bullying complaint
A Taipei court has thrown out Taiwan Railway's decision to move an employee out of his HR job after he reported workplace bullying — a win for the worker and a warning to the company.
- The employee, surnamed Yang, reported workplace mistreatment in 2023 and was then shifted out of the personnel department into a sales and rail operations role.
- The court said the transfer broke the rule that staff should be placed where their skills fit, since Yang passed the civil service exam for personnel work, not tourism or rail operations.
- Taiwan Railway could not show any real business need that made the move necessary, so the court ruled it went beyond reasonable discretion.
- Yang had gone public with a handwritten open letter to the transport and labor ministers asking for a fair hearing, and the railway union backed him.
- A separate internal probe found the bullying claim unproven, and his appeal of that was rejected — the court case was only about the legality of the transfer.
Outlook: Yang's old job is automatically restored now that the order is cancelled, but Taiwan Railway can still appeal.
