Keelung man fined for drinking beer in parked car wins court appeal
A Taiwanese court threw out a drunk-driving fine against a man who drank beer in his own parked car, a win for drivers caught in a legal gray zone.
- Police in Keelung found the man parked on a red no-parking line with his engine running, breath-tested him, and hit him with a NT$30,000 fine plus a two-year plate suspension.
- The man said he had already parked outside his home at 2am, called his wife to unlock the door, and only then opened two beers because it was hot.
- The Taipei High Administrative Court reviewed his dashcam audio and confirmed the can-opening sounds came after he parked, and the car never moved again.
- Judges also pointed to his folded-in side mirror as proof he was getting out, not preparing to drive, and said police could not show he drank before or while driving.
Outlook: The ruling can still be appealed, but it sets a clear marker that a running engine alone does not make someone a drunk driver.
