Ma Wen-chun Loses Suit Against Yen Tse-ya; Court Rules Submarine Budget Remarks Open to Public Comment

The Taipei District Court has ruled against Kuomintang legislator Ma Wen-chun, a decision that is good news for freedom of speech in Taiwan and for the space to criticise public officials, and a setback for Ma.

  • Ma Wen-chun sued writer Yen Tse-ya for smearing her by claiming she had advocated "cutting the entire submarine budget," seeking NT$2.5 million in damages along with the deletion of the post and a published apology in the press. All of her claims were dismissed.
  • The court held that public figures must accept scrutiny, that Yen Tse-ya had verified her information beforehand, and that the core facts matched Legislative Yuan records, so this did not amount to malicious fabrication.
  • The ruling noted that commentary need not match the original words verbatim; as long as the main facts do not depart from reality, it is protected by freedom of speech.
  • A separate case involving Ma Wen-chun herself — the actual "submarine case" — is still before the courts, with no result yet.
